15.    Discussion and decision regarding acquisition of two (2) pumper tenders and a utility pickup truck for PVFRS with PETT and General Fund Fire Capital Funds. PVFRS Chief/Town Manager.

16.    Town Manager’s report.

18.    Consent Agenda.

Call to Order, Pledge of Allegiance, and Welcome.

    Chairperson Murray called the meeting to order at 7:00 PM.

Discussion and decision regarding agenda items.

    Member Rust motioned to continue item #10 to August 28th.  Member Sprouse    seconded.  Motion carried 5/0.

    Member Sprouse motioned to table item #11 to September 25th.  Member Rust    seconded.  Motion carried 5/0.

    Item #16 deleted.

Public Comment. Action may not be taken on matters considered during this period until specifically included on an agenda as an action item (NRS241.020 (2) (C) (3).

    Bill Garlough recommended the Veteran’s Memorial lease be open to all    veteran’s associations.

    Lawrence Baker, Secretary of the Nevada Well Owners Association, stated the    resignations of the Public Lands Advisory Board Members were handled unfairly.


Pahrump Town Board Meeting        
August 14, 2007

    Butch Clendenen expressed his dissatisfaction about the proposed prison being    built in his neighborhood.

    Bob Eizer stated he was a new resident and was opposed a proposed prison.

Announcements and Good News.

    Member Rust stated Wednesday, August 15th, 11:30 AM Senator Reid would    conduct a Town hall meeting at Rudd Community Center, and at 6:00 PM the     Regional Planning Commission (RPC) would meet.  He added Friday, August     17th and 24th there would be a continuation of the Outdoor Movie Night and     August 21st and 22nd, 8:30 AM, at the Ruud Community Center was the Nye     County Board of County Commissioners (BOCC) meeting and Tuesday, August     28th was the Pahrump Town Board Meeting.

    He stated Saturday, August 18th, 10 AM to 4 PM was the Wellness Options    Forum sponsored by BRCC and Saturday at 6 PM to Sunday at 6 AM was the     American Cancer Society’s Relay For Life.  He added Saturday, August 25th at 6     PM was the United Way Luau at Honeysuckle Park, Friday, August 24th thru     September 1st was the MDA Boot Drive at Smith’s and Albertsons and the     Mamovan would be in Pahrump on August 27th and 28th.  

Advisory Board reports.

    Member Sprouse met with Nuclear Waste & Environmental Advisory Board to    discuss alternative energy for Town vehicles and a Fall Festival booth.

    Chairperson Murray reminded Board members of the Town booth at the Fall    Festival which was available to all Advisory Boards.

Discussion and decision closure of meeting pursuant to NRS241.031 to consider the character, alleged misconduct, professional competence, or physical or mental health of Carolyn Westphal.

    Member Sprouse motioned to close the meeting.

    Member Rust seconded.

Pahrump Town Board Meeting        
August 14, 2007

Discussion and possible decision on issues presented in the Closed Meeting.

    Member Rust motioned the disciplinary action be modified to be an official    reprimand to be placed in the employees personnel folder and removed     after the next annual evaluation.

    Member Sprouse seconded.

    Motion carried 3/2 (McDonald and Shupp opposed).

Proclamation declaring November 1st through the 4th “Pahrump Senior Olympic Days”.

    Member Rust read the proclamation. 

    Member McDonald motioned to pass the proclamation as read by the Clerk.

    Member Sprouse seconded.

    Motion carried 5/0.

Discussion and decision regarding establishing a seven (7) member Town of Pahrump Incorporation Advisory Board.

    Member Rust motioned for a late application from Janet Painter to be accepted    as back up.

    Member Shupp seconded.

    Motion carried 5/0.

    Member Rust stated nine (9) applications were received.  He motioned for the    Board to create a seven (7) member Advisory Board, with two (2) alternate     members.  The members were:  Bob Irving, Robert Aberle, Darce Wilson, Allan     Parker, Bill Verbeck, Billy Toller, Charlie Gronda and the alternates would be     Janice Painter and Margaret Long.

    Member Shupp seconded.

    Billy Toller recommended Charles Gronda as Chairman.  Harley Kulkin    questioned the criteria for selection.

Pahrump Town Board Meeting

    Motion carried 5/0.

Discussion and decision regarding the expansion of current recycling efforts by Pahrump Valley Disposal.

    Continued.

Discussion and decision regarding lease agreement with Support Your Soldiers in Need (SSI) Foundation to facilitate a Veteran’s Memorial Museum at the Chief Tecopa Cemetery.

    Tabled until September 25, 2007.

Discussion and decision regarding establishing a Chief Tecopa Cemetery Veteran’s Memorial Advisory Board.

    Chairperson Murray stated the Veteran’s portion of the cemetery was for the    community and recommended the public property remain under the Town,     available to all citizens.  She recommended an oversight Board that operates in     the public eye, interacts with Buildings and Grounds, and represents the various     Veterans’ organizations in the community with the Town Board making the final     decisions.  Member Sprouse recommended a museum curator.  

    Dr. Elliott Brainard, Jose Telles, Terry Choice and Bill Dawson volunteered to be    members of the Advisory Board.  Ted Serta, Bill Garlough, Tom Ward, George     Gingell, Harley Kulkin, Jim Scott, and Mr. Vincent spoke in favor of appointing     an Advisory Board.

    Member Rust motioned to establish Chief Tecopa Veteran’s Memorial Advisory    Committee which would include selection of a volunteer curator and that     applications for membership on this Advisory Board be accepted at the Town     Office until September 15, 2007 at which time a decision would be made on     board size based on the number of applications received.  

    Member Sprouse seconded.

    Motion carried 5/0.

Discussion and decision regarding Resolution 2007 – 13 recommending the Nye County Board of Commissioners accept the letter of agreement for the Indian Road Subdivision Development.

    Member Rust read the Resolution title. 
Pahrump Town Board Meeting        
August 14, 2007

    Member McDonald motioned to approve Resolution 2007-13, a Resolution    requesting Nye County Board of Commissioners approval of development     agreement terms for the Indian Road subdivision development project.

    Member Sprouse seconded.

    Motion carried 5/0.

Discussion and decision regarding corrections to base pay in employment agreements for Buildings and Grounds Manager and PVFRS Chief.

    The Town Manager stated the base pay for both was calculated in error and this    item allowed for approval of both agreements with revisions.

    Member Rust motioned to accept the revised employment agreements for the    Buildings and Grounds Manager and Pahrump Valley Fire and Rescue Chief.

    Member Shupp seconded.

    Motion carried 5/0.
    
Discussion and decision regarding acquisition of two (2) pumper tenders and a utility pickup truck for PVFRS with PETT and General Fund Fire Capital Funds.

    Chief Lewis stated PETT funds of $393,000.00 were available, one half of the    cost of the vehicles.  The Chief requested permission to go forward with the     project and place the order.  

    The Town Attorney cited a Nevada Revised Statute (NRS) and recommended a    bid process.  

    Harley Kulkin and Robert Smith recommended used equipment. 

    Member Rust motioned to proceed with acquisition of two pumper tenders and a    utility pickup truck subject to review by the Town Attorney as to bid process and     not to exceed $575,000.00 paid from PETT Funds and the General Fund Capital.

    Member Sprouse seconded.

    Motion carried 5/0.
