Peggy Warner explained that this is regarding ten acre feet of water rights.(Should have been 30 acre feet.)

Paula Glidden stated that she received the notice last week and she sent a notice to Dave Richards to let him know she could put comparisons together and to let her know which property.  Ms. Glidden said she did not hear back from him so she did put together a comparison list of what is available for sale today.  Ms. Glidden explained her comparison and pointed out that water rights are currently going for $10,000 an acre foot if you can find any available.  Paula Glidden further explained the purpose of this purchase would be to get the water rights for the Town and then sell the property.  Ms. Glidden explained that there is a planning issue with regards to the water rights and said that the property would have to be sold as one big block to make it sellable.  Paula Glidden said it is her opinion that the land prices are inflated at this time.  

Jeanna Howard explained that she spoke with Mr. Smith on August 6, not knowing it was the person owning the property being considered.  Ms. Howard said she called an advertisement in the paper and found it to be Mr. Smith who told her he had already spoken with Mr. Richards.  Jeanna Howard said that Mr. Smith said that he is not closed to just selling the water rights for $15,000 per acre foot.  Ms. Howard said we would not have to purchase the land.  Jeanna Howard said she tried to reach Dave Richards after this conversation with Mr. Smith but was unable to reach him.  

Paula Glidden noted that there are other options out there and that values must be placed on this.

Peggy Warner pointed out the assessor’s assessment of the property which is different from the information provided by Mr. Richards.

Paula Glidden discussed the donation of water rights by Tim Hafen for the fairgrounds.  Ms. Glidden explained that Tim Hafen is donating 10 acre feet of water rights to the Town and encouraged other water rights owners to do the same.

Charlotte LeVar asked what happened with the purchase of water rights that was offered previously through the bid process and who was responsible.

Peggy Warner explained that the water rights were not lost.  Mrs. Warner said she was working on them.

Paula Glidden said the State cannot help on this and will not give the Town any exceptions.  Ms. Glidden pointed out that the County owns water rights and they are not even shown on the list.  Paula Glidden said she asked Hugh Ricci and was told there are no exceptions.

Charlotte LeVar suggested getting that in writing as there is a certain amount of responsibility that the State owes to its communities, as well as Nye County.  Paula Glidden asked that Peggy Warner ask for there decisions in writing.  Mrs. LeVar suggested getting on the County agenda to request water rights.  Charlotte LeVar pointed out that it will be known as Pahrump/Nye County Fairgrounds and the County should be accountable as well.  

Peggy Warner stated that she was told no by Ron Williams a few years ago.

Paula Glidden asked for a better list of water rights owners as there is a difference in this list and the Calvin Morrison list which includes the entire Pahrump Basin.   Ms. Glidden asked when a decision on this has to be made.  

Ms. Glidden asked what is it the Town wants to pay for water rights and is it something the Town wants to do.  This property has 30 acre feet of water rights available at $15,000 per acre foot.  This would make the land value at $200,000 for 10 acres.  

Jeanna Howard asked where the money would come from.  Peggy Warner said that there is $300,000 in fairgrounds from a Nye County grant.  Paula Glidden noted that it was going to be used for water rights anyway.  Mrs. Warner said there is approximately $250,000 in Room Tax.  Charlotte LeVar verified that there is $650,000 in Town Capital.  Peggy Warner said there is.  

Paula Glidden asked what would be done with the ten acres.  There was discussion regarding whether to parcel the land or keep it whole and it was noted that there are two wells, one domestic and one for irrigation.  

Jeanna Howard explained that is the reason for him being on the verge of losing the water rights.  He should be farming six acres and he is not.  Ms. Howard noted that Mr. Smith has an offer on the table from Focus Group for $10,000 per acre foot.  Paula Glidden explained that at $10,000 per acre foot of water rights would come to $300,000 and would make the land value $350,000.

Jeanna Howard said she personally does not care about the land unless it works out to be a better deal.  Ms. Howard, in her discussion with Mr. Smith said that with her finding out he has spoken

to Dave Richards she tried to end the conversation but did mention that the Town is lost in moving forward in many projects and to please consider giving the Town priority before selling.  

Paula Glidden suggested offering $11,000 per acre foot.  Paula Glidden asked if Mr. Smith was looking for a bid from the Town.  Ms. Howard said she did not want to duplicate efforts with Mr. Richards.  It appears to Ms. Howard that Mr. Smith is not sharing the same information with all of the people.  Mr. Richards did not include the option of not purchasing the land and can only assume he did not know.  Or Mr. Smith may have changed his mind after the initial conversation with Dave Richards.

Jeanna Howard said she would like to pursue purchasing the water rights without the land and make an offer of $10,500 on the water rights.  Ms. Howard asked how many water rights are need for the fairgrounds.  According to Mr. Hafen’s figures the fairgrounds will need at least 100 acre feet.  

Charlotte LeVar noted that if these water rights were purchased, and with Mr. Hafen’s 10 acre feet, that would be 40.  Paula Glidden pointed out that Tim Hafen is saying 239 acre feet are needed for the fairgrounds.  This would be for the entire three phases of the project.  

Charlotte LeVar gave her opinion of the need for ball fields at the fairgrounds.  Paula Glidden said she would like to see artificial turf at the fairgrounds and will ask the Fairground Advisory Board to do a proposal to find out the cost.   Jeanna Howard agreed with Mrs. LeVar and noted that we need to be more water conscience.  

Jeanna Howard said she is unsure of how to move forward.  Ms. Howard asked if the Board would consider an offer of $10,500 to $11,000 per acre foot with Mr. Smith.  

Charlotte LeVar asked if there is anyone else to go to.  This was brought to the table because Dave Richards saw the advertisement in the paper.  Mrs. LeVar asked if there are others that are about to lose their water rights that the Town can pick up.  Jeanna Howard replied that Focus Group solicited letters to everyone on the list.  

Paula Glidden explained that she has been in contact with Donna Lamm who has extensive knowledge regarding water rights.  Even Donna Lamm cannot find any she told Ms. Glidden.  

Paula Glidden said she is hoping that if the Town would pick up these water rights and continue to get donations from the others, the Town could propose to the State that they have received most of what is needed and ask the State for an exception.  Charlotte LeVar agreed with Ms. Glidden that it would be a show of good faith that the Town has done what it could.

Jeanna Howard suggested that this may be a legislative issue and feels that governments should be exempt from having to go through this procedure for water rights.  Paula Glidden agreed.  Ms. Glidden stated that this project (fairgrounds) will add to the Town by bringing in money.

Peggy Warner asked on a positive note if the Town Board is willing to accept the 10 acre feet from Tim Hafen to be moved to the fairgrounds.  Charlotte LeVar, Jeanna Howard and Paula Glidden agreed.  Charlotte LeVar asked if there will be a problem with the point of diversion. Peggy Warner said the Town will still have to pay the money.  Mrs. Warner explained that it would cost the Town approximately $2,000 for each diversion.  Paula Glidden added that there will be no more blocks of 80 (water rights) available.  

Charlotte LeVar asked if the Board would be considering only the water rights or the entire property.  Jeanna Howard replied that she would like to stay away from the property.  Mrs. LeVar asked how far the airport is from Mr. Smith’s parcel.  Paula Glidden replied it is approximately three miles as the crow files.  Charlotte LeVar said she would not like the community to think they had a chance to put a small mall in the area.  Ms. Glidden stated it is in a residential area not commercial area and other developments are planned in that area.  

Paula Glidden stated that she agrees with Jeanna Howard on the land part of the deal.  Ms. Glidden said if the Town purchased the land there is no telling how long the Town may be stuck with it.  Developers are currently land banking.

Charlotte LeVar Motioned to adjourn to closed session.  Jeanna Howard seconded the motion.

Vote passed 3 – 0.

CLOSED SESSION

DISCUSSION, ACTION AND DECISION REGARDING MATTERS DISCUSSED IN CLOSED SESSION

Paula Glidden stated that for the record the Town is looking at the purchase of land and/or water rights for the Town and for usage at the fairgrounds.

Jeanna Howard Motioned to offer Mr. Smith$10,500 up to $11,000 per acre feet for the entire amount of 30 acre feet.  Charlotte LeVar seconded the motion.  

Vote passed 3 – 0.
